Kratom, Road Traffic Law & MPU: What Drivers Need to Know

The Legal Basis

German road traffic law has two relevant norms. § 24a StVG (administrative offence): driving under the influence of a substance listed in the annex. Kratom alkaloids are not on this list. § 316 StGB (criminal offence: driving under the influence): driving when unable to safely operate a vehicle due to "other intoxicating substances" – broadly defined, not dependent on listing. If actual driving impairment exists through kratom consumption, § 316 StGB is applicable.

The MPU: Medical-Psychological Examination

The MPU ("fitness to drive test") can be ordered when doubts about driving aptitude exist. For kratom: MPU assessors follow medical guidelines where kratom is not yet explicitly addressed (as of 2025/2026) – no standardised threshold values exist. This cuts both ways: no automatic response to kratom use, but broad discretion if signs of misuse or dependence exist.

What This Means for Kratom Buyers

  • Kratom alkaloids are not listed under § 24a StVG – no automatic fine based on blood detection alone
  • Actual driving impairment under § 316 StGB is always possible if impairment is present
  • MPU can be ordered even for non-listed substances if drug-related concerns exist
  • Laboratory detection is possible if specifically tested – standard rapid tests do not detect it

The legal gap does not protect against all consequences. Anyone consuming kratom and driving operates in a legal grey area that could darken at any time.
